This Agreement is entered into by Love Power Up, LLC (“Love Power Up,” “We,” “Us,” or “Our”), the developer of the Novel Crafter app service (the “App,” “Service,” or “Services”), and the entity or person agreeing to these terms (the “Customer,” “You,” or “Your”), and governs Your access to and use of the Services.
For purposes of this Agreement, “Assets” means any content, materials, novel projects, manuscript text, chapters, outlines, plot ideas, character lists, character roles, location lists, story worlds, story codex materials, AI-generated writing, AI-generated suggestions, AI review comments, beta-reader style feedback, written summaries, notes, project data, exported files, software components, or other information generated, provided, stored, exported, or made available through the Services, whether created by You, created by Us, generated by automated systems, or supplied by third parties.
This Agreement is effective when You are presented with this Agreement and proceed to use the Services or to receive, view, save, export, publish, share, or distribute Assets. These terms may be updated and presented again from time to time. Continued use of the Services constitutes acceptance of the updated terms. If You do not agree to this Agreement, please stop using the Services.
Novel Crafter allows users to plan, organize, write, review, and develop novel projects. The Services may include tools for creating and managing character lists, character roles, locations, chapters, plot ideas, outlines, manuscript text, story worlds, story codex materials, AI-assisted writing, AI-assisted brainstorming, AI-assisted chapter writing, AI plot generation, AI chapter list generation, AI character generation, AI review comments, beta-reader style feedback, and related writing features.
The Services are intended to support creative writing, story planning, manuscript development, organization, brainstorming, drafting, and revision. The Services are not a publisher, literary agent, professional editor, legal advisor, copyright advisor, writing coach, or guarantee of publication, completion, originality, quality, sales, reviews, rankings, representation, or commercial success.
We are constantly improving the Services to make them better. The Services are subject to modification and change. No guarantees are made with respect to the Services’ quality, stability, uptime, reliability, accuracy, availability, or continued operation. Please do not create any dependency on any particular feature, attribute, output, timing, export format, storage function, project limit, generation limit, or availability of the Services. We will not be liable to You or any third party for any harm caused by Your dependency on the Services.
By accessing the Services, You confirm that You are at least 18 years old and meet the minimum age of digital consent in Your country. The Services are intended only for adults. You may not use the Services if You are under 18 years old.
If You are a parent or legal guardian and You believe that a minor has accessed or used the Services, please contact Us so that We may take appropriate action.
By using the Services, You may provide Us with personal information such as Your email address, user name, billing information, app activity, novel project materials, manuscript text, saved history, and other information that You enter, submit, save, or export. Please see Our Privacy Policy.
The App may allow You to submit text, prompts, manuscript drafts, chapters, outlines, character descriptions, character roles, location descriptions, story world details, genre preferences, notes, plot ideas, review requests, feedback requests, and other writing materials in order to generate, organize, review, comment on, or export creative writing content (“User Submissions”). You are solely responsible for the accuracy, completeness, lawfulness, originality, ownership, permissions, and appropriateness of any User Submissions You provide.
You grant Love Power Up a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, process, analyze, transmit, display, generate outputs from, convert, and export Your User Submissions solely as reasonably necessary to provide, maintain, operate, and improve the Services, including creating and managing novel projects, chapters, character lists, locations, story codex materials, AI-assisted writing, AI-generated suggestions, AI review comments, beta-reader style feedback, history entries, exports, and other Assets.
You should not submit highly sensitive personal information, confidential information, third-party private information, third-party copyrighted works, unpublished third-party manuscripts, legal documents, medical records, financial account numbers, passwords, government identification numbers, or emergency information through the Services unless You have the necessary rights and accept the risks of doing so.
Novel Crafter may offer subscription plans that provide access to AI writing assistance, AI generation, AI chapter writing, plot generation, chapter list generation, character generation, story codex tools, beta-reader style feedback, project organization, multiple novel projects, series sharing features, export features, priority AI writing, and related premium features. Subscription options may include, without limitation, monthly subscription plans and yearly subscription plans. Available plans, pricing, features, usage limits, project limits, generation limits, trial offers, and promotions may vary by country, platform, currency, taxes, App Store settings, and time.
Subscription options may include:
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period, or as otherwise required by the applicable app store or subscription platform. Your account may be charged for renewal within 24 hours before the end of the current billing period. You are responsible for managing and canceling Your subscription through Your Apple App Store account settings, Google Play account settings, or other applicable platform settings.
If You cancel a subscription, You will generally continue to have access to the subscribed features until the end of the then-current billing period, unless otherwise stated by the applicable app store or platform. We do not provide refunds or credits for partial billing periods, unused access, unused AI generations, unused project capacity, unused export features, or accidental purchases, except where required by law or by the applicable app store rules.
Subscription plans may include limits on the number of novels, AI generations, AI writing requests, AI review requests, chapter generation requests, character generation requests, export requests, or other premium uses available during a particular period. Usage limits may be calculated daily, weekly, monthly, yearly, per billing period, per account, per device, per project, or in another manner determined by Us or by the applicable app store or platform.
AI generations and other usage benefits are provided on a use-it-or-lose-it basis. If Your subscription plan includes a weekly AI generation allotment, any unused AI generations expire at the end of the applicable weekly usage period and do not accumulate, roll over, bank, carry forward, become available retroactively, or transfer to any later week, billing period, subscription plan, account, or device.
Unused AI generations, project capacity, exports, writing requests, review requests, or other usage benefits are not cash, credits, stored value, or property rights, and are not redeemable for refunds, credits, money, additional subscription time, or other value, unless expressly stated in the App or required by law. We may determine, in Our discretion, when a usage period begins, when it resets, how usage is calculated, and whether a generation, export, writing request, review request, or other feature has been used.
The App may use automated systems, artificial intelligence, machine learning, text generation technologies, algorithms, or other automated technologies to generate plot ideas, chapter lists, character details, manuscript text, suggested revisions, writing suggestions, story comments, beta-reader style feedback, summaries, and other Assets. You acknowledge that AI-generated outputs may contain errors and may be incomplete, inaccurate, inconsistent, subjective, biased, generic, repetitive, unexpected, unsuitable, or inappropriate for Your specific project, genre, audience, or intended use.
AI-generated writing, suggestions, comments, and feedback are provided for creative assistance, brainstorming, drafting, organization, and revision. They should not be treated as professional editing, legal advice, copyright advice, publishing advice, literary representation, academic advice, or a guarantee that any content is original, accurate, publishable, lawful, commercially viable, or suitable for any particular purpose.
Generated writing, plot ideas, character descriptions, outlines, comments, and other outputs may vary in quality and may not always match Your expectations, preferences, prompt, genre, tone, plot direction, style, or intended meaning. Some outputs may fail, be delayed, be unavailable, or be restricted by technical limitations, safety systems, third-party service rules, or content moderation systems.
As between You and Love Power Up, You retain ownership of Your original User Submissions, including novel ideas, manuscript drafts, chapters, outlines, character materials, locations, notes, and other creative materials that You create and submit to the Services, subject to the license You grant Us in these Terms so that We can provide, maintain, operate, and improve the Services.
Love Power Up does not claim ownership of Your novel projects, manuscripts, chapters, character lists, outlines, locations, story codex materials, or exported files merely because You use the Services. Subject to these Terms, applicable law, and any third-party service provider terms that may apply, You may use AI-generated text outputs and related Assets in Your own writing projects.
You are solely responsible for determining whether any User Submission, AI-generated output, manuscript, chapter, character, outline, plot, story element, export, or other Asset is suitable for publication, commercial use, submission to publishers, agents, contests, schools, platforms, marketplaces, or any other use. We do not guarantee that any output is protectable by copyright, free from third-party claims, commercially usable, or eligible for publication or registration.
AI-generated outputs may resemble existing ideas, themes, tropes, phrases, settings, characters, plot structures, genre conventions, writing styles, or outputs generated for other users. The Services do not guarantee that any output is unique, original, copyrightable, non-infringing, plagiarism-free, publication-ready, commercially viable, or acceptable to any publisher, agent, editor, contest, school, platform, marketplace, or reader.
You are responsible for reviewing, editing, fact-checking, originality-checking, rights-checking, and otherwise evaluating all User Submissions, outputs, manuscripts, chapters, exports, and other Assets before publishing, submitting, selling, sharing, printing, distributing, or relying on them. You are also responsible for complying with any disclosure requirements, submission rules, publisher policies, contest rules, school rules, platform rules, marketplace rules, contracts, or laws that may apply to AI-assisted content.
The App may provide AI-assisted writing, plot ideas, chapter lists, character generation, story organization, comments, and feedback intended to help with creative writing projects. You understand and agree that the Services do not guarantee that You will finish a novel, improve Your writing, create a successful manuscript, obtain literary representation, secure a publishing deal, sell books, earn income, receive positive reviews, achieve rankings, win contests, satisfy readers, or obtain any other creative, professional, educational, personal, or commercial result.
You agree not to treat any AI-generated writing, suggestion, comment, review, plot idea, chapter outline, character idea, beta-reader style feedback, export, or other Asset as a statement of fact, professional advice, publishing advice, legal advice, copyright advice, editorial guarantee, or guarantee that any particular creative or commercial result will occur.
The App may allow You to export novel projects, chapters, manuscript text, outlines, notes, comments, or other Assets to .txt, .docx, PDF, or other file formats, if offered. Export features, supported file formats, formatting options, file names, metadata, limits, and availability may be added, removed, changed, restricted, or discontinued at any time.
Exported files may not perfectly preserve formatting, structure, comments, chapter organization, headings, indentation, spacing, special characters, metadata, images, footnotes, page breaks, style settings, or layout. You are responsible for reviewing all exported files before submitting, publishing, printing, selling, sharing, distributing, uploading, or relying on them.
We are not responsible for export errors, formatting issues, file corruption, failed downloads, unavailable exports, lost files, incompatible files, inaccurate conversion, metadata issues, or problems caused by third-party software or services, including without limitation Microsoft Word, Google Docs, Apple Pages, Scrivener, cloud storage services, email providers, publishing platforms, printing services, or other writing, editing, conversion, storage, or distribution tools.
We reserve the right to suspend or ban Your access to the Services at any time, and for any reason.
You may not:
We reserve the right to investigate complaints or reported violations of Our Terms of Service and to take any action We deem appropriate, including but not limited to reporting suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing information necessary or appropriate to such persons or entities relating to user profiles, email addresses, usage history, submitted materials, IP addresses, and traffic information.
User Submissions, novel projects, manuscripts, chapters, character lists, character roles, location lists, story codex materials, outlines, plot ideas, notes, AI-generated writing, AI review comments, beta-reader style feedback, exports, saved content, preferences, history entries, or other Assets may be stored persistently for convenience within the App and to provide project, history, organization, writing, review, export, or related functionality. However, Love Power Up does not guarantee permanent storage, backup, availability, accuracy, integrity, preservation, synchronization, exportability, or recoverability of any such content or outputs.
If the App is deleted, Your device is changed, access is lost, data is deleted, phone data is lost or corrupted, Your subscription ends, Your account is closed, an export fails, a file is corrupted, a project limit is exceeded, or the App’s local or associated storage is cleared, Your User Submissions, novel projects, manuscripts, chapters, character lists, location lists, story codex materials, outlines, plot ideas, notes, AI-generated writing, AI review comments, beta-reader style feedback, exports, saved content, preferences, history entries, and other Assets may be permanently lost. You are responsible for maintaining independent backups and copies of any manuscripts, chapters, projects, exports, or other content that You wish to keep.
Novel Crafter should not be treated as the only copy or backup of Your manuscript, novel project, story world, character materials, chapters, notes, comments, exports, or other writing materials.
The Services may use or interact with third-party services, including artificial intelligence providers, text generation providers, cloud hosting providers, analytics providers, payment processors, app stores, document conversion or export providers, storage providers, and other vendors. Third-party services may be subject to their own terms, privacy policies, availability, restrictions, and technical limitations. We are not responsible for any third-party service, third-party output, third-party failure, third-party delay, third-party policy, or third-party content.
Love Power Up does not monitor all User Submissions and has no obligation to review, verify, validate, or confirm the accuracy, legality, originality, safety, consent, ownership, permissions, rights, or appropriateness of any submitted information, manuscript text, novel project, chapter, character material, location material, story codex material, AI-generated writing, AI review comment, beta-reader style feedback, export, or other output. We reserve the right, but have no obligation, to remove, restrict, or refuse any content or output at Our discretion.
To the fullest extent permitted by law, Love Power Up LLC and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits or any other financial losses, arising from:
Both the Services and the Assets are provided to You on an “AS IS” and “AS AVAILABLE” basis, without warranties or conditions of any kind, either express or implied, including, without limitation, any warranties or conditions of title, non-infringement, merchantability, fitness for a particular purpose, accuracy, reliability, availability, originality, copyrightability, commercial usability, publication readiness, exportability, or suitability. You are solely responsible for determining the appropriateness of using the Services and assume any risks associated with use of the Services.
The Services are not intended to provide legal advice, copyright advice, publishing advice, professional editing, literary representation, business advice, financial advice, medical advice, psychological advice, mental health advice, therapeutic advice, relationship advice, safety advice, investment advice, tax advice, employment advice, or other professional advice.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT NEITHER LOVE POWER UP NOR ITS OFFICERS, EMPLOYEES, DIRECTORS, SHAREHOLDERS, LICENSORS, SERVICE PROVIDERS, AFFILIATES, AND AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF GOODWILL, USE, DATA, MANUSCRIPTS, CREATIVE WORK, EXPORTS, WRITING TIME, PUBLISHING OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, EVEN IF LOVE POWER UP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, RESULTING FROM: (A) THE USE OR THE INABILITY TO USE THE SERVICES OR ANY RELATED INFORMATION; (B) UNAUTHORIZED ACCESS TO THE SERVICES; (C) CONDUCT OF ANY THIRD PARTY, INCLUDING OTHER USERS, OF THE SERVICES; OR (D) ANY OTHER MATTER RELATING TO THE SERVICES. IN NO EVENT WILL LOVE POWER UP’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE GREATER OF (I) ONE HUNDRED DOLLARS ($100) OR (II) THE PRICE YOU PAID FOR THE SERVICE IN THE LAST TWELVE (12) MONTHS. IF YOU ARE MERELY DISSATISFIED WITH ANY PORTION OF THE SERVICES OR WITH THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE SERVICES.
You will indemnify, defend, and hold harmless Love Power Up and its affiliates, shareholders, officers, directors, employees, agents, and representatives from and against any and all claims, including all damages, judgments, costs, and expenses, including reasonable attorneys’ fees (“Claims”), arising out of and relating to (a) any Claims concerning information submitted by You, including User Submissions, manuscripts, chapters, character materials, location materials, story codex materials, exported files, and other submitted content, (b) Your submission of User Submissions without necessary rights, permissions, or consents, (c) Your use of the Services, including Your access to, use of, sharing of, publication of, reliance on, or misuse of the Services or Assets, (d) any claim that Your User Submissions, manuscripts, exports, or use of AI-generated outputs infringes, plagiarizes, misappropriates, violates, or resembles the rights, works, privacy, publicity, intellectual property, contract rights, or other interests of any third party, or (e) Your violation of these Terms of Service, including use of the Services in violation of these Terms of Service.
ALL LEGAL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT, INCLUDING ANY DISPUTE REGARDING THE INTERPRETATION OR PERFORMANCE OF THE AGREEMENT (“Dispute”), WILL BE GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA, USA, EXCLUDING CALIFORNIA’S CONFLICTS OF LAWS RULES.
The parties will try in good faith to settle any Dispute within 30 days after the Dispute arises. If the Dispute is not resolved within 30 days, it shall be resolved by arbitration by the American Arbitration Association in accordance with its Expedited Commercial Rules in force as of the date of this Agreement (“Rules”). The parties will mutually select one arbitrator. The arbitration will be conducted in English in Los Angeles County, California, USA.
Either party may apply to any competent court for injunctive relief necessary to protect its rights pending resolution of the arbitration. The arbitrator may order equitable or injunctive relief consistent with the remedies and limitations in the Agreement.
The arbitral award will be final and binding on the parties, and its execution may be presented in any competent court, including any court with jurisdiction over either party or any of its property. Each party will bear its own lawyers’ and experts’ fees and expenses, regardless of the arbitrator’s final decision regarding the Dispute.
Neither party will be liable for failure or delay in performance to the extent caused by circumstances beyond its reasonable control, including acts of God, natural disasters, terrorism, riots, pandemics, war, labor disputes, power failures, internet failures, platform outages, app store disruptions, cloud provider failures, artificial intelligence provider failures, export provider failures, storage provider failures, or other events beyond reasonable control.
If You do not comply with a portion of these Terms and We do not take action right away, this does not mean We are giving up any of Our rights under these Terms. If any part of these Terms is determined to be invalid or unenforceable by a court of competent jurisdiction or arbitrator, the remainder of the Terms shall be enforced to the maximum extent permitted by law.
