This Agreement is entered into by Love Power Up, LLC (“Love Power Up,” “We,” “Us,” or “Our”), the developer of the Astrotalk app service (the “App,” “Service,” or “Services”), and the entity or person agreeing to these terms (the “Customer,” “You,” or “Your”), and governs Your access to and use of the Services.
For purposes of this Agreement, “Assets” means any content, materials, AI-generated coaching reflections, personal growth prompts, practical action steps, visual motivation cards, AI-generated pictures, images, visuals, written summaries, daily coaching entries, history entries, graphics, data, software components, or other information generated, provided, or made available through the Services, whether created by Us, generated by automated systems, or supplied by third parties.
This Agreement is effective when You are presented with this Agreement and proceed to use the Services or to receive, view, save, or distribute Assets. These terms may be updated and presented again from time to time. Continued use of the Services constitutes acceptance of the updated terms. If You do not agree to this Agreement, please stop using the Services.
Astrotalk allows users to choose a life area, such as Health, Wealth, or Romance, provide optional details about what they are working through, and receive AI-generated coaching reflections, practical action steps, and related AI-generated visual motivation cards. The Services are intended to support daily reflection, goal clarity, personal growth, motivation, and self-guided journaling.
The Services do not provide professional advice, do not guarantee any outcome, and should not be used as the basis for important life, health, financial, legal, relationship, safety, or professional decisions.
We are constantly improving the Services to make them better. The Services are subject to modification and change. No guarantees are made with respect to the Services’ quality, stability, uptime, reliability, accuracy, availability, or continued operation. Please do not create any dependency on any particular feature, attribute, output, timing, or availability of the Services. We will not be liable to You or any third party for any harm caused by Your dependency on the Services.
By accessing the Services, You confirm that You are at least 18 years old and meet the minimum age of digital consent in Your country. The Services are intended only for adults. You may not use the Services if You are under 18 years old.
If You are a parent or legal guardian and You believe that a minor has accessed or used the Services, please contact Us so that We may take appropriate action.
By using the Services, You may provide Us with personal information such as Your email address, user name, billing information, app activity, submitted coaching details, saved history, and other information that You enter or submit. Please see Our Privacy Policy.
The App may allow You to submit text, prompts, questions, preferences, goals, concerns, or other information in order to generate AI coaching reflections, practical action steps, and visual motivation cards (“User Submissions”). You are solely responsible for the accuracy, completeness, lawfulness, and appropriateness of any User Submissions You provide.
You grant Love Power Up a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, process, analyze, transmit, display, and create outputs from Your User Submissions solely as reasonably necessary to provide, maintain, operate, and improve the Services, including generating AI coaching reflections, practical action steps, visual motivation cards, history entries, and other Assets.
You should not submit highly sensitive personal information, confidential information, third-party private information, medical records, financial account numbers, legal documents, passwords, government identification numbers, or emergency/crisis information through the Services.
Astrotalk may offer subscription plans that provide access to daily AI coaching reflections, practical action steps, visual motivation cards, AI-generated pictures, and related premium features. Subscription options may include, without limitation, a weekly subscription, monthly subscription, and yearly subscription. Available plans, pricing, features, trial offers, and promotions may vary by country, platform, currency, taxes, App Store settings, and time.
Subscription options may include:
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period, or as otherwise required by the applicable app store or subscription platform. Your account may be charged for renewal within 24 hours before the end of the current billing period. You are responsible for managing and canceling Your subscription through Your Apple App Store account settings, Google Play account settings, or other applicable platform settings.
If You cancel a subscription, You will generally continue to have access to the subscribed features until the end of the then-current billing period, unless otherwise stated by the applicable app store or platform. We do not provide refunds or credits for partial billing periods, unused access, missed coaching days, or accidental purchases, except where required by law or by the applicable app store rules.
Astrotalk is designed as a daily coaching and reflection experience. While Your subscription is active, You may receive or generate one new AI coaching reflection, practical action step, and related visual motivation card approximately every 24 hours, subject to App functionality, availability, technical limitations, and subscription status.
Daily coaching reflections, practical action steps, visual motivation cards, AI-generated pictures, and related daily benefits do not accumulate, roll over, bank, carry forward, or become available retroactively. If You do not open the App, request Your coaching session, or otherwise use the Services on a particular day, You will not receive additional coaching content for the day or days You missed. Missed days are not refundable, redeemable, transferable, or creditable.
We may determine, in Our discretion, when a new 24-hour period begins, how daily access is calculated, and whether a coaching reflection, action step, visual motivation card, or AI-generated picture has been used or generated for a particular period.
The App may use automated systems, artificial intelligence, machine learning, image generation technologies, algorithms, or other automated technologies to generate AI coaching reflections, practical action steps, personal growth prompts, visual motivation cards, AI-generated pictures, and other Assets. You acknowledge that AI-generated outputs may contain errors and may be incomplete, inaccurate, inconsistent, subjective, biased, unexpected, repetitive, unsuitable, or inappropriate for Your specific circumstances.
AI-generated pictures and visual motivation cards are created for entertainment, inspiration, motivation, and personal reflection. They may be symbolic, abstract, stylized, fictional, imperfect, or inaccurate. They should not be interpreted as factual depictions, professional advice, or evidence of any real event, person, future outcome, health condition, financial opportunity, relationship result, or life circumstance.
Generated coaching reflections, action steps, visual motivation cards, and pictures may vary in quality and may not always match Your expectations, preferences, prompt, category selection, or intended meaning. Some outputs may fail, be delayed, be unavailable, or be restricted by technical limitations, safety systems, third-party service rules, or content moderation systems.
The Services provide AI-generated coaching-style reflections, personal growth prompts, practical action steps, visual motivation cards, and inspirational content for entertainment, motivation, and personal reflection only. The App does not provide medical advice, mental health advice, psychological advice, therapy, crisis counseling, financial advice, investment advice, tax advice, legal advice, employment advice, safety advice, relationship counseling, or any other professional advice.
You should not use the Services as a substitute for advice from a qualified physician, therapist, psychologist, financial advisor, attorney, accountant, relationship counselor, safety professional, emergency responder, or other qualified professional. You are solely responsible for how You interpret, use, rely on, share, or act upon any coaching reflection, action step, visual motivation card, AI-generated picture, or other Asset.
Wellness: Wellness-related coaching reflections are for general reflection, motivation, and entertainment only. It is not medical advice and should not be used to diagnose, treat, prevent, cure, or manage any illness, injury, condition, symptom, medication, diet, exercise program, mental health issue, or medical decision. If You have health concerns, contact a qualified healthcare professional. If You believe You may be experiencing a medical emergency, contact emergency services immediately.
Money: Money or goal-related coaching reflections are for general reflection, motivation, and entertainment only. It is not financial, investment, tax, legal, business, employment, accounting, or professional advice. The App does not recommend securities, investments, business decisions, purchases, sales, employment actions, financial strategies, or legal actions. You should consult qualified professionals before making financial, legal, tax, employment, or business decisions.
Relationships: Relationship-related coaching reflections are for general reflection, motivation, and entertainment only. It is not therapy, relationship counseling, safety planning, legal advice, or a guarantee of compatibility, attraction, reconciliation, commitment, marriage, dating success, or any relationship outcome. If You are experiencing abuse, coercion, stalking, threats, harassment, domestic violence, or danger, seek help from qualified professionals, trusted support resources, or emergency services.
The Services are not designed for emergencies, crisis situations, or urgent professional support. Do not use the App for urgent medical issues, mental health crises, self-harm concerns, threats of harm, abuse, domestic violence, financial emergencies, legal emergencies, or other urgent situations. If You or someone else may be in danger, contact emergency services, a crisis hotline, a qualified professional, or trusted local resources immediately.
The App may provide coaching-style reflections, personal growth prompts, suggested action steps, motivational content, or visual cards related to personal goals, wellness, money, relationships, habits, opportunities, and life circumstances. You understand and agree that the Services do not guarantee any personal improvement, health improvement, financial result, relationship outcome, business success, emotional result, habit change, goal achievement, dream fulfillment, or other result.
You agree not to treat any coaching reflection, action step, AI-generated picture, visual motivation card, interpretation, recommendation, or other Asset as a statement of fact, professional advice, or a guarantee that any particular event, improvement, or outcome will occur.
We reserve the right to suspend or ban Your access to the Services at any time, and for any reason.
You may not:
We reserve the right to investigate complaints or reported violations of Our Terms of Service and to take any action We deem appropriate, including but not limited to reporting suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing information necessary or appropriate to such persons or entities relating to user profiles, email addresses, usage history, submitted materials, IP addresses, and traffic information.
User Submissions, AI coaching reflections, practical action steps, visual motivation cards, AI-generated pictures, history entries, saved content, preferences, or other Assets may be stored persistently for convenience within the App and to provide history or related functionality. However, Love Power Up does not guarantee permanent storage, backup, availability, or recoverability of any such content or outputs.
If the App is deleted, Your device is changed, access is lost, data is deleted, phone data is lost or corrupted, Your subscription ends, Your account is closed, or the App’s local or associated storage is cleared, Your User Submissions, AI coaching reflections, practical action steps, visual motivation cards, AI-generated pictures, history entries, saved content, preferences, and other Assets may be permanently lost. You are responsible for maintaining any copies of content or outputs that You wish to keep.
The Services may use or interact with third-party services, including artificial intelligence providers, image generation providers, cloud hosting providers, analytics providers, payment processors, app stores, and other vendors. Third-party services may be subject to their own terms, privacy policies, availability, restrictions, and technical limitations. We are not responsible for any third-party service, third-party output, third-party failure, third-party delay, third-party policy, or third-party content.
Love Power Up does not monitor all User Submissions and has no obligation to review, verify, validate, or confirm the accuracy, legality, safety, consent, ownership, or appropriateness of any submitted information, generated coaching reflection, action step, visual motivation card, AI-generated picture, or other output. We reserve the right, but have no obligation, to remove, restrict, or refuse any content or output at Our discretion.
You agree that You are not relying on the App as Your primary source of coaching, advice, prediction, health information, medical coaching, mental health coaching, financial coaching, investment coaching, tax coaching, legal coaching, relationship coaching, safety coaching, or professional advice, and that any decision to use, share, interpret, or act upon the App’s outputs is made solely by You.
To the fullest extent permitted by law, Love Power Up LLC and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits or any other financial losses, arising from:
Both the Services and the Assets are provided to You on an “AS IS” and “AS AVAILABLE” basis, without warranties or conditions of any kind, either express or implied, including, without limitation, any warranties or conditions of title, non-infringement, merchantability, fitness for a particular purpose, accuracy, reliability, availability, or suitability. You are solely responsible for determining the appropriateness of using the Services and assume any risks associated with use of the Services.
The Services are not intended to provide financial, legal, medical, psychological, mental health, therapeutic, relationship, safety, investment, tax, employment, or other professional advice.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT NEITHER LOVE POWER UP NOR ITS OFFICERS, EMPLOYEES, DIRECTORS, SHAREHOLDERS, LICENSORS, SERVICE PROVIDERS, AFFILIATES, AND AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF LOVE POWER UP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, RESULTING FROM: (A) THE USE OR THE INABILITY TO USE THE SERVICES OR ANY RELATED INFORMATION; (B) UNAUTHORIZED ACCESS TO THE SERVICES; (C) CONDUCT OF ANY THIRD PARTY, INCLUDING OTHER USERS, OF THE SERVICES; OR (D) ANY OTHER MATTER RELATING TO THE SERVICES. IN NO EVENT WILL LOVE POWER UP’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE GREATER OF (I) ONE HUNDRED DOLLARS ($100) OR (II) THE PRICE YOU PAID FOR THE SERVICE IN THE LAST TWELVE (12) MONTHS. IF YOU ARE MERELY DISSATISFIED WITH ANY PORTION OF THE SERVICES OR WITH THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE SERVICES.
You will indemnify, defend, and hold harmless Love Power Up and its affiliates, shareholders, officers, directors, employees, agents, and representatives from and against any and all claims, including all damages, judgments, costs, and expenses, including reasonable attorneys’ fees (“Claims”), arising out of and relating to (a) any Claims concerning information submitted by You, including User Submissions and other submitted content, (b) Your submission of User Submissions without necessary rights, permissions, or consents, (c) Your use of the Services, including Your access to, use of, sharing of, reliance on, or misuse of the Services or Assets, or (d) Your violation of these Terms of Service, including use of the Services in violation of these Terms of Service.
ALL LEGAL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT, INCLUDING ANY DISPUTE REGARDING THE INTERPRETATION OR PERFORMANCE OF THE AGREEMENT (“Dispute”), WILL BE GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA, USA, EXCLUDING CALIFORNIA’S CONFLICTS OF LAWS RULES.
The parties will try in good faith to settle any Dispute within 30 days after the Dispute arises. If the Dispute is not resolved within 30 days, it shall be resolved by arbitration by the American Arbitration Association in accordance with its Expedited Commercial Rules in force as of the date of this Agreement (“Rules”). The parties will mutually select one arbitrator. The arbitration will be conducted in English in Los Angeles County, California, USA.
Either party may apply to any competent court for injunctive relief necessary to protect its rights pending resolution of the arbitration. The arbitrator may order equitable or injunctive relief consistent with the remedies and limitations in the Agreement.
The arbitral award will be final and binding on the parties, and its execution may be presented in any competent court, including any court with jurisdiction over either party or any of its property. Each party will bear its own lawyers’ and experts’ fees and expenses, regardless of the arbitrator’s final decision regarding the Dispute.
Neither party will be liable for failure or delay in performance to the extent caused by circumstances beyond its reasonable control, including acts of God, natural disasters, terrorism, riots, pandemics, war, labor disputes, power failures, internet failures, platform outages, app store disruptions, cloud provider failures, artificial intelligence provider failures, or other events beyond reasonable control.
If You do not comply with a portion of these Terms and We do not take action right away, this does not mean We are giving up any of Our rights under these Terms. If any part of these Terms is determined to be invalid or unenforceable by a court of competent jurisdiction or arbitrator, the remainder of the Terms shall be enforced to the maximum extent permitted by law.
